WEB ACCESS / Home Banking is available 24 hours a day, 7 days a week except during maintenance periods or circumstances beyond our control. There is no charge for WEB ACCESS. This service is free to you the member. You are however, responsible for obtaining, installing, maintaining and operating all computer hardware, software and Internet access services necessary for performing WEB ACCESS services. We will not be responsible for any errors or failures from the malfunction or failure of your computer hardware, software or any Internet access services. When you use, or permit any other person(s) to use SOCU WEB ACCESS, you agree to the terms and conditions of this Agreement. In addition to this Agreement, you agree to comply with all account agreements you currently have with us including, without limitation, the agreements that you received when opening your depository account, as amended, and with all applicable State and Federal laws and regulations. You are responsible for maintaining the confidentially of your password and User ID. If you choose to give your user ID or password to anyone else, you are responsible for all WEB ACCESS transactions that may occur. You, the member, are the only person authorized to transfer funds or request checks from your account(s) with the use of your WEB ACCESS User ID and password. Tell us at once if you believe your WEB ACCESS password has been LOST or STOLEN. Your best way to prevent losses is to call us. If you believe that your WEB ACCESS password has been LOST or STOLEN, or that someone has transferred or may transfer money from your account without permission, call us at (800) 357-8586. You could lose all the money in your account (plus your maximum overdraft line of credit). If you tell us within two (2) business days, you can lose no more than FIFTY DOLLARS ($50.00) if someone used your WEB ACCESS password without permission. If you do NOT tell us within two (2) business days after you learn of the loss or theft of your WEB ACCESS password and we can prove that we could have stopped someone from using your WEB ACCESS password without your permission if you had told us, you could lose as much as FIVE HUNDRED DOLLARS ($500.00). Also, if your statement shows transfers that you did not make, tell us within sixty (60) days after the statement was mailed to you. You may authorize a WEB ACCESS transfer on available funds from your share draft account as often as you like. However, you may perform no more than six funds transfers per month from any share savings account. If you exceed the maximum amount, we may take any steps we deem necessary to ensure your compliance with your account agreements with us, including terminating your WEB ACCESS service. We reserve the right to refuse any transaction that would draw upon insufficient funds or lower and account below a required balance. WEB ACCESS transactions initiated before midnight will be posted to the appropriate account on the next business day. Upon completions of a transaction using WEB ACCESS, you will be able to view a printable confirmation. You will also receive a monthly statement of your account activity. You will not receive any other slip or confirmation of a WEB ACCESS transaction from the CU Office. If you tell us orally, we may require that you send us your complaint of question in writing within 10 business days. DISCLAIMER OF WARRANTIES: THE WEB ACCESS SERVICES AND RELATED DOCUMENTATION ARE PROVIDED “AS IS”, AND WE DO NOT MAKE ANY WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED, CONCERNING THE HARDWARE, THE SOFTWARE, THE WEB ACCESS SERVICE OR ANY PART THEROF, INCLUDING, WITHOUT LIMITATION, NO VIRUSES OR ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. LIMITATION OF LIABILITY: THE FOREGOING SHALL CONSTITUTE OUR ENTIRE LIABILITY AND YOUR EXCLUSIVE REMEDY. IN NO EVENT SHALL WE BE LIABLE FOR ANY LOSS, INJURY OR DAMAGES, WHETHER DIRECT, INDIRECT, SPECIAL, INCIDENTIAL, EXEMPLARY OR CONSEQUENTIAL, INCLUDING LOST PROFITS, CAUSED BY US OR ARISING IN ANY WAY OUT OF THE INSTALLATION, USE OR MAINTENANCE OF YOUR PERSONAL COMPUTER HARDWARE, EQUIPMENT, SOFTWARE OR ANY INTERNET ACCESS SERVICES. You may terminate this agreement by sending us thirty (30) days prior written notice. You agree that we may suspend your access to WEB ACCESS, or terminate this agreement at any time. Any termination shall have no effect on your responsibility as it pertains to transactions or activity, which may be pending or otherwise previously initiated. The provisions of this agreement that protect our proprietary rights shall survive the termination of this agreement. Your instructions to us to transfer fund will continue in effect until we have received your request and have a reasonable opportunity to act upon it.
